1. Heard Mr.A.N. Patel, learned counsel appearing for the petitioner and Ms.Asmita Patel, learned A.G.P. appearing for respondent No.1.
2. By way of this petition under Article 226 of the Constitution of India, the petitioner has prayed for the following reliefs:-
"(A) Your Lordships may be pleased to a writ of mandamus and or direction of any other appropriate writ, order or direction to the respondent no.1 to fix the early date of hearing of the Revision Application no.65,67 and 68 of 2010 in the interest of justice.
(B) During the pendency and final disposal of this petition, this Hon'ble Court may be pleased to direct to maintain status quo by both party in the interest of justice.
(C) Any other and further relief deemed fit be granted in the interest of justice."
3. Mr.Patel, learned counsel drawn attention of this Court to the fact that a similar application has been filed on 02.07.2012. However, no orders are passed by the Secretary, Revenue Department (Appeals) and, therefore, this petition is filed.
4. Considering the averments made in the petition and also considering the submissions made by learned counsel Mr.Patel, prayers, as prayed for in the petition, cannot be considered by this Court. However, it would be open for the petitioner to file an appropriate application before the Secretary, Revenue Department (Appeals), Ahmedabad for expediting the final hearing of Revision Application No.65 of 2010.
5. In view of the above, if any such application is filed, as aforesaid, the Secretary, Revenue Department (Appeals), Ahmedabad shall consider and decide the same along with application dated 02.07.2012 (Annexure-A-Collectively at Page 17-18 to the petition ) within a period of four weeks from the date of receipt of copy of this order and fix the main matter as per his convenience.
6. With the above observations, the petition stands disposed of.
