JUDGMENT / ORDER

The petitioners herein are the four accused in C.C.No.150/2011 of the Judicial First Class Magistrate Court-III, Palakkad. Crime in the said case was registered under Sections 341 and 324 read with 34 IPC, on the complaint of one Hrishikesh. Petitioners now seek orders quashing the prosecution, on the ground that they and the complainant have come to terms amicably. The defacto complainant, Hrishikesh is the 2nd respondent in this proceeding. He has filed affidavit to the effect that he has settled the dispute with the accused, and that he has no grievance or complaint. I am well satisfied that there is a real settlement between the parties, and that continuance of prosecution in such a situation will not serve any purpose. No doubt, none of the material witnesses will support the prosecution, if the case goes to trial. In the result, this Crl.M.C. is allowed. The prosecution against the petitioners in C.C.No.150/2011 of the Judicial First Crl.M.C. No. 6631 of 2014 2 Class Magistrate Court-III, Palakkad, will stand quashed under Section 482 Cr.P.C. Accordingly, the petitioners will stand released from prosecution. The bail bond, if any, executed by the petitioners will stand discharged.
