Heard learned counsel for the parties.
The writ court vide order dated 26.11.2018 allowed the writ petition. The operative portion of the order is extracted:
"3. From the materials brought on record, this Court finds that the issue that petitioner's appointment was approved in the year 2006 and she continued to work till she attained the age of superannuation on 31st March, 2018 are facts, which are not in dispute. The judgment of this Court in Writ Petition No.1159 of 2016 holding that the approval would relate back to the period of expiry of one month from the date of appointment has attained finality. It is otherwise not in issue that petitioner had actually worked since 1st July, 2003 and has been paid salary also. In such circumstances, the issue of validity of petitioner's appointment ought not to be made the basis for denial of retiral benefits to her. Consequently, order dated 13.8.2018 cannot be sustained and is, accordingly, quashed.
4. A direction is issued to the respondents to forthwith consider petitioner's claim for grant of retiral benefits, in accordance with law, within a period of three months from the date of presentation of certified copy of this order.
5. With the aforesaid observations/directions, this writ petition stands disposed of. No order as to costs."
Sri K.R. Singh, learned counsel appearing for the opposite party no. 1, submits that in compliance of the writ court order the opposite party no. 1 has passed an order dated 18 September 2019. The relevant portion of the order is extracted:
"उपरोक्त तथ्यों, वि))ेचना ए)ं उपलब्ध अभि5लेखो के आधार पर स्पष्ट हो रहा है विक याची के चयन, विनयविु क्त ए)ं काय"5ार ग्रहण कराने में प्रबन्धक द्वारा माध्यविमक भि,क्षा अधिधविनयम की उक्त धाराओं का उल्लंघन विकया गया , जि5सके लिलए प्रबन्धक उत्तरदायी हैं। याची की याधिचका सं०- 72086/2005 में पारिरत आदे, विदनांक 23.11.2005 के आलोक में याची की विनयविु क्त का अनुमोदन विदनांक 18.02.2006 को विकया 5ा चुका है, जि5सके क्रम में विदनांक 22.02.2006 से विनरन्तर )ेतन 5ुगतान पाते हुए तथा न)ीन अं,दायी पें,न यो5नान्तग"त आच्छाविदत रहते हुए याची विदनांक 31.03.2018 को से)ाविन)ृत्त हो चकी है। श्रीमती वि)नोरमा प्रसाद (याची) द्वारा तत्कालीन जि5ला वि)द्यालय विनरीक्षक के विनस्तारण आदे, 18.02.2006 को स्)ीकार करते हुए ,ासन द्वारा विनधा"रिरत एन०पी०एस० यो5ना के अन्तग"त प्रान नं० आ)ंविFत कराने हेतु आ)ेदन विकया। प्रान नम्बर 110044903497 आ)ंFन के उपरान्त एन०पी०एस० के अन्तग"त वि)5ाग द्वारा विनयमानुसार )ेतन से अं,दान की कFौती की गई। याची की विनयविु क्त ए)ं विनयम वि)रूद्ध/दोषपूण" प्रविक्रया के अन्तग"त काय"5ार ग्रहण कराकर वि))ाद उत्पन्न कराने हेतु प्रबन्धतंत्र/प्रबन्दक उत्तरदायी हैं। इस प्रकार याची द्वारा अ),ेष )ेतन ) अन्य देयकों आविद के सम्बन्ध में की 5ा रही मांग की देयता वि)5ाग पर न बनते हुए संस्था प्रबन्धतंत्र/प्रबन्धक पर बनतीहै। अतः संस्था प्रबन्धतंत्र/ प्रबन्धक अपने विन5ी श्रोतो से याची की मांग के अनुरूप देयता आविद की काय")ाही सुविनधिRत कर। याची का प्रत्या)ेदन विदनांक 24.08.2019 अधिधविनयविमत व्य)स्था के अन्तग"त न होने के कारण अस्)ीकार विकये 5ाने योग्य है। विनण"य-
उपरोक्त तथ्यों, वि))ेचना ए)ं विनष्कष" के आधार पर मा० उच्च न्यायालय के आदे, विदनांक 25.07.2019 के अनपालन में श्रीमती वि)नोरमा प्रसाद का प्रत्या)ेदन विदनांक 24.08.2019 बलहीन ए)ं आधारहीन होने के कारण विनरस्त करते हुये विनस्तारिरत विकया 5ाता है।"
I have perused the order with the assistance of learned counsel for the parties. The order clearly records that since the approval was granted on 18 February 2006, therefore, applicant is not entitled to the post retiral dues for the period w.e.f. 1 July 2013 to 17 February 2006.
In my opinion, the order, ex facie, is wilful and deliberate disobedience of the writ court order. The opposite party, District Inspector of Schools, District Etah, shall appear for framing of charge.
