JUDGMENT / ORDER

This writ petition has been filed alleging non- feasance on the part of the respondents 1 and 2 in taking an action against the 4th respondent for running a flour mill without a licence from the first respondent and consent to operate from the third respondent. The 4th respondent is conducting a flour mill by name 'Bismi Flour Mill' in Kangarappady junction. The learned standing counsel appearing for the first respondent submitted that the petitioner started functioning of the flour mill on the strength of the licence issued by the first respondent. It is further submitted by the learned standing counsel that the 5th respondent has, now, produced a consent to operate issued by the third respondent in respect of the said flour mill. In the said circumstances it is also stated that the party respondents viz., respondents 4 and 5 have already approached the first respondent with an application for renewal of the licence and they have also produced a copy of consent to operate issued by the third respondent. In the said circumstances this writ petition is disposed of with a direction to the second respondent to W.P.(C) No.2608 of 2014 2 consider the application submitted by the 4th or 5th respondent for renewal of the licence granted by the first respondent for running the aforesaid flour mill expeditiously and at any rate within a period of one month from the date of receipt of a copy of this judgment. Needless to say that before passing orders thereon, the petitioner and respondents 4 and 5 shall also be put on notice. Sd/-
