ORDER ON THE CRIMINAL MISC. BAIL APPLICATION Heard the learned counsel for the appellant and the learned AGA for the State on the first bail application in the instant criminal appeal moved on behalf of accused – appellant.
We have perused the judgment and order dated 22.01.2015 passed by the trial court convicting the appellant in S.T. No. 330 of 2007 arising out of Case Crime No. 1 of 2017, under Section 302, 307, 323, 506 of IPC, Police Station Nagla Khanger, District Firozabad.
We have perused the record. The appellant is the sole assailant and specific role of firing has been assigned to the appellant. Medical evidence supports ocular evidence and eye witness account is also present. There is single injury to the deceased.
Learned AGA has opposed the prayer for bail.
In view of the aforesaid facts and circumstances, we do not find it a fit case for bail. The bail application moved on behalf of appellant is hereby rejected at this stage.
