Heard learned counsel for the applicant and learned A.G.A. for the State.
The present bail application has been filed for enlarging the applicant on bail in S.T. No.816 of 2016, Case Crime No. 68 of 2016, u/s 498-A, 304-B IPC and 3/4 D.P. Act at Police Station Aliganj, District Bareilly.
Learned counsel for the applicant has contended that applicant is the husband of deceased, who has been falsely implicated in the present case. Learned counsel has drawn attention of this Court to the dying declaration of the deceased, in which no role has been assigned to the applicant, copy of which has been filed as Annexure-3 to the affidavit accompanying the application and all the witnesses, whose statements were recorded before the trial court have turned hostile. It is lastly contended that the applicant has been falsely implicated and has no criminal antecedent. The applicant is in jail since 23.7.2016.
Learned A.G.A. has vehemently opposed the bail application.
After hearing learned counsel for the applicant and learned A.G.A., and after perusing the averments made in the present bail application, this Court is of the opinion that learned counsel for the applicant could not point out any good ground for grant of bail to the applicant at this stage.
Accordingly, the bail application filed on behalf of the applicant is hereby rejected.
However, after passing of the order, learned counsel for the applicant prays that trial in the present case may be directed to be decided expeditiously.
In view of the aforesaid submissions, it is directed to the court below that the trial of aforesaid case crime be decided most expeditiously strictly in accordance with law after hearing the parties without granting any unnecessary adjournment to either of the parties.
