Heard learned counsel for the petitioner and the learned A.G.A. for the State.
It is alleged that the petitioner was involved in an alleged racketeering fraudulent voter ID proofs during general elections. Learned counsel submits that his name has surfaced on the alleged confessional statement of the person who is stated to be in possession of such fake documents. The implication is alleged to be false.
We have considered the submissions raised and the disclosure in the first information report does indicate a case which deserves investigation. We are therefore not inclined to quash the first information report dated 29.11.2017 in Case Crime No.451 of 2017, under Sections 420, 468, 471 I.P.C. Police Station Singhawali Aheer district Baghpat.
It is open to the petitioner to surrender before the court below and seek bail which shall be disposed of expeditiously keeping in view the law laid down in the case of Lal Kamlendra Pratap Singh Vs. State of U.P. reported in 2009 (3) ADJ, 332(SC) and Amarwati and another Vs. State of U.P. reported in 2004 (57) ALR, 290.
The writ petition stands disposed of with the said observation.
