Heard learned counsel for the petitioners; learned AGA for respondents 1, 2 and 3; and perused the record.
The instant petition seeks quashing of the First Information Report dated 8th April, 2019 registered as Case Crime No.126 of 2019, under Sections 147, 148, 323, 504, 354 and 452 IPC at Police Station Chiluatal, District Gorakhpur.
The allegations levelled in the first information report disclose commission of cognizable offences. According to the allegations victims were assaulted and they had to be rushed to primary health centre and were referred to the medical college for treatment. Informant's sister's modesty was also outraged.
As the allegations disclose commission of cognizable offences and the petitioners are named in the first information report, no case to quash the first information report is made out.
The petition is dismissed with liberty to the petitioners to apply or bail.
