Heard Sri Manish Tiwary, learned Senior Advocate assisted by Sri Atharva Dixit, learned counsel for the petitioners and the learned AGA.
This writ petition has been filed praying for the following reliefs:
"(i) Issue a writ, order or direction in the nature of certiorari quashing the impugned First Information Report dated 8.11.2021 registered as Case Crime No. 0404 of 2021, under Sections 376D, 323, 326, 506, 406 IPC, Police Station- Ganj, District- Rampur (Annexure No. 1 to this writ petition).
(ii) Issue a writ, order or direction in the nature of mandamus commanding the respondents not to arrest or harass the petitioners in pursuance of impugned First Information Report."
After the arguments were heard at some length, learned Senior Advocate for the petitioners states that the petitioners want to withdraw the writ petition with liberty to apply for bail.
Learned A.G.A. has no objection to the aforesaid request of the petitioners.
In view of the aforesaid, the writ petition is disposed off with liberty to the petitioners to apply for bail in accordance with law.
It is made clear that we have not expressed any opinion on merits of the case of the petitioners.
