JUDGMENT / ORDER

Hon'ble Vishnu Chandra Gupta,J.
Heard learned counsel for the appellant, learned A.G.A. for the State and perused the record.
Prayer for bail has been made by appellant- Vinod Lodh, who has been convicted under sections 376,342,506 I.P.C. and u/s 3(2)(5) SC/St Act and sentenced to undergo maximum sentence of life imprisonment with a fine of Rs. 25,000/- by Special Judge, SC/ST Act, District Unnao in Sessions Trial No. 96/2005, arising out of Case Crime No. 417/05 , P.S. Gangaghat, District - Unnao.
It is submitted on behalf of the appellant that according to the medical report no injury was found. At the time of medical examination the procutrix was major. It is further submitted that sentence is excessive.
Considering the facts and circumstances of the case, without commenting on the merit of the case, we consider it to be a fit case for bail.
Accordingly, prayer for bail is accepted. The appellant-Vinod Lodh shall be released on bail in aforementioned case on his executing personal bond with two sureties of like amount to the satisfaction of the court concerned.
Till further orders, realization of fine, if any, shall remain stayed.
