Heard learned counsel for the petitioner and perused the record.
In view of the order proposed to be passed, notices need not issue to the respondents no. 1 and 2.
The petitioner is before this Court for a direction to the Civil Judge (Junior Division), Court No. 2 Gorakhpur to decide the Civil Suit No. 392 of 2008 (Old No. 2738 of 2017), Ram Kripal Vs. Raghunath Prasad Yadav and another) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Junior Division), Court No. 2, Gorakhpur to consider and decide the aforesaid suit in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
