Heard learned counsel for the petitioner, learned A.G.A. for the State /respondent nos.1 to 3 and Sri Gauri Shankar Yadav, learned counsel for the respondent No. 4.
Present writ petition has been filed for quashing the F.I.R. dated 15.02.2018, which has been registered as Case Crime No. 159 of 2018 under Section 135 of Electricity Act, Police Station Shikohabad, District Firozabad.
It is contended by learned counsel for the petitioner that the allegation against the petitioner is that of consuming electricity without obtaining the electricity connection.
Learned counsel for the respondent No. 4 Sri Gauri Shankar Yadav contends that the petitioner, who is consuming electricity, has not paid any amount.
After hearing the learned counsel for the parties and perusing the material on record, this writ petition is disposed of with the direction that in case, the petitioner moves application for compounding as per law within a period of fifteen days from today before the authority concerned, the same shall be considered and appropriate orders be passed by the respondent No.3, as per law, within a period of one month thereafter.
Subject to moving appropriate application as stipulated above, coercive action against the petitioner shall be kept in abeyance for a period of two month or till the decision of application of the petitioner, whichever is earlier.
In case, the petitioner does not move appropriate application as stipulated above, protection granted above shall automatically stands vacated.
