Heard learned counsel for the parties. The vakalatnama filed by Shri Amrendu Singh, Advocate for Shri Mahendra Pal Singh, who has not been arrayed as party respondent in the writ petition, is taken on record.
The petitioner is before this Court assailing the order dated 3.2.2018 passed by the District Supply Officer, Gorakhpur- fourth respondent by which the shop in question in favour of the petitioner has been cancelled and for a direction to the Commissioner, Gorakhpur to decide the appeal in question expeditiously.
On the matter being taken up on 18.7.2018 the Court has proceeded to pass the following interim order:-
"Heard learned counsel for the petitioner and learned counsel for the State.
The State shall file its reply on or before 2.8.2018. Mr. Mahendra Pal Singh, the M.L.A. shall also specify as how and under what law he was authorized to inspect fair price shop of the petitioner.
The order impugned shall remain stayed till 2.8.2018 and the petitioner shall be permitted to be granted quota. The meeting which was ordered to be held on 16.7.2018 will not be given effect to as there is serious allegations against the M.L.A. Mr. Mahendra Pal Singh of nepotism.
In that view of the matter, this order is necessary."
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue and with the consent, the writ petition stands disposed of asking the appellate authority to decide the appeal in question in accordance with law expeditiously and preferably within three months from the date of production of certified copy of this order. For a period of three months or till the disposal of appeal, whichever is earlier, the interim order so accorded by this Court on 18.07.2018 shall continue.
