Heard learned counsel for the petitioner and learned Standing Counsel appearing for respondent nos.1 to 5.
Instant writ petition has been filed seeking following reliefs :
“(i) issue a writ, order or direction in the nature of mandamus directing respondent no.4 Sub Divisional Transport Officer, District- Mainpuri to register his vehicle I-10 Sportz 1.2 BS IV Car in accordance with the Motor Vehicles Act, 1988 within a stipulated period as fixed by this Hon'ble Court.
(ii) issue a writ, order or direction in the nature of mandamus directing the respondents to consider and decide the representation of the petitioner dated 20.6.2020 pending before the respondent no.5, District Magistrate, Mainpuri within a stipulated period as fixed by this Hon'ble Court (Annexure No.5 to this writ petition).”
Submission of learned counsel for the petitioner is that he had purchased a I-10 Sportz 1.2 BS IV Car in 2013, but due to some unavoidable reasons, its registration could not be done, hence, he moved an application before the A.R.T.O. for registration of the vehicle. However, a report has been submitted to the concerned District Magistrate by the A.R.T.O. that its registration cannot be done as the vehicle was purchased on 18.10.2013. Thereafter, petitioner moved a representation before respondent no.5, District Magistrate, Mainpuri, but the same is still pending for consideration.
In this view of the matter, respondent no.5 is directed to consider and pass an appropriate order on the application of the petitioner expeditiously, appended as Annexure-5 to the writ petition, preferably within a period of four weeks from the date of receipt of a copy of this order.
Writ petition is, accordingly, disposed of.
