After a deficiency of Rs.7,27,500/- was found by the Additional Commissioner (Stamp) Aligarh, the petitioner filed an Appeal which was also dismissed on 16.04.2021. Hence the instant writ petition has been filed.
Learned counsel for the petitioners has submitted that none of the grounds as was taken by the petitioners, was considered by the two authorities.
Matter requires consideration.
Learned Standing Counsel may file counter affidavit within a period of three weeks. Rejoinder affidavit, if any, may be filed within a period of two weeks thereafter.
List thereafter.
If the petitioners deposit 50 per cent of the deficiency found by the Additional Commissioner (Stamp) Aligarh, the impugned orders dated 16.04.2021 passed by Deputy Commissioner (Stamp), Aligarh and the order dated 15.11.2019 passed by Additional Commissioner (Stamp) Aligarh, shall remain stayed. Any amount which has already been deposited shall be adjusted towards the deposit the petitioners shall now make. Needless to mention here that the penalty shall remain stayed.
