This application under Section 482 Cr.P.C. has been filed with the prayer to set aside the order dated 09.7.2015 passed by learned Principal Judge, Family Court, Etah in Case No. 584 of 2009, Smt. Gayatri Devi and another vs. Vinod Kumar, under Section 125 Cr.P.C., P.S.- Kotwali Dehat, District- Etah and the order dated 5.09.2017 passed by the Principal Judge, Family Court, Etah in Case No. 238 of 2015, under Section 128 Cr.P.C. by which recovery warrant for arrears of maintenance of Rs. 3,24,000/- has been issued.
Heard learned counsel for the applicant and learned A.G.A. for the State. Perused the record.
Learned counsel for the applicant has not been able to point out any such illegality or impropriety, much less than any abuse of court's process which may persuade this Court to interfere in the impugned orders. Additional submission has been made by the applicant's counsel that some easy installment may be made. So far as this prayer is concerned, it is directed that the applicant will have the liberty to move an application before the court below and made the same prayer there. If such application is moved by the applicant within two weeks from today, the court concerned shall look into the same and pass appropriate orders as it may deem fit in accordance with law. If the court decides to make some easy installments it may do so on the strength of the directions issued by this Court in exercise of its inherent jurisdiction.
With the aforesaid observations, this application stands disposed off.
