Heard learned counsel for the petitioner, learned Standing Counsel for State and Sri Vivek Saran, learned counsel for respondent No. 2.
The petitioner is alleged to have moved an application before the 2nd respondent for mutation of his name in place of his mother Veero Devi, who had died on 02.06.2020. According to the petitioner, his mother was duly constituted attorney of Dharmendra Singh for obtaining sale of plot from the second respondent. The petitioner has filed the instant petition for a mandamus directing the second respondent to decide his application dated 04.02.2021.
Sri Vivek Saran, learned counsel for the respondent No. 2 tried to contend that as per the sale deed the petitioner may not have right to seek mutation. He, however, very fairly states that second respondent will pass speaking order on the application of the petitioner.
Accordingly, without going into merits of this case, we dispose of this petition with a direction to second respondent to pass speaking order on the application dated 04.02.2021 within four weeks from the production of true attested copy of the instant order.
The petition stands disposed of accordingly.
