The instant application u/s. 482/483 Cr.P.C has been filed with prayer to expedite the case bearing complaint case no. 1262 of 2008 (Old No. 760 of 1995) (Chandra Shekhar Singh vs. Vinod Kumar Singh @ Atul Singh and others) arising out of application under sections 500, 469, 471, 473 IPC, PS. Mehdawal, District Sant Kabir Nagar pending before Civil Judge (S.D.)/A.C.J.M., Sant Kabir Nagar.
The complainant Chandra Shekhar Singh filed a complaint on the basis of complaint filed on 15.07.1995 before the Court below. The learned Magistrate has taken the cognizance over the complaint and registered the case as Complaint case no. 760 of 1995 and now the case is numbered as 1262 of 2008.
The applicant appeared before the Court below and obtained bail on 08.01.1998. He further submitted that the complainant died on 26.08.1999. The applicant on the other hand submitted that he always present in the Court on the date fixed but nobody has been appearing on behalf of the complainant. Therefore, the matter has been adjourned from time to time.
Since the matter is pending since 1995 and several dates have been fixed for hearing but nothing had been done, learned Civil Judge (S.D.)/A.C.J.M., Sant Kabir Nagar is directed to dispose of complaint case no. 1262 of 2008 (Old No. 760 of 1995) (Chandra Shekhar Singh vs. Vinod Kumar Singh @ Atul Singh and others) under sections 500, 469, 471, 473 IPC, PS. Mehdawal, District Sant Kabir Nagar expeditiously preferably within six months from the date of this order.
The application stands disposed of.
