Heard learned counsel for the petitioner and learned Standing Counsel for the respondents.
Learned counsel for the petitioner submits that the order which has been impugned in the writ petition has been recalled by the State Government on 26.07.2021. However, he contends that gratuity, leave encashment and salary of the suspension period has not been released in favour of petitioner.
As the impugned order has been recalled by the State Government, therefore, no cause of action survives in the writ petition.
However, if dues of gratuity, leave encashment and salary of the suspension period is not released to petitioner, it is open to him to avail appropriate remedy as available in law.
With the aforesaid observations, the writ petition is disposed off.
