Sri Vivek Saran, learned counsel has put in appearance on behalf of the second respondent.
Heard learned counsel for the parties.
Petitioner, Senior Assistant Clerk, retired from the office of the third respondent-District Magistrate/District Election Officer, Kasganj on 31 July 2018.
By the instant writ petition, petitioner seeks following relief:
"to issue a writ order or direction of appropriate nature commanding the respondent authorities to forthwith and expeditiously make payment of pension and other post retiral benefits of the petitioner alongwith interest for the delay in payment in accordance with law and if possible, within the time stipulated by this Hon'ble Court."
Learned Standing Counsel submits that the third respondent- District Magistrate/District Election Officer, Kasganj, shall pass appropriate order, in accordance with law.
In view thereof, on consent, the petition is disposed of directing the third respondent-District Magistrate/District Election Officer, Kasganj, to consider and decide the representation of the petitioner by reasoned and speaking order, expeditiously, preferably within a period of two months from the date of filing of certified copy of this order alongwith copy of the writ petition.
It is clarified that the Court has not considered the claim of the petitioner on merits.
