Heard Mr. N.L Tripathi, learned counsel for the applicant and the learned A.G.A. for the State.
This application under Section 482 Cr.P.C. has been filed challenging the summoning order dated 18.6.2018, passed by the Additional Session Judge/Special Judge (U.P.D.A.A.), Lalitpur in Complaint Case No. 48 of 2015 (Vinod Kumar Rathaur Vs. Ravi Shankar Rathur and Others), under sections 395, 397 IPC, P.S. Kotwali, District Lalitpur as well as the entire proceedings of above mentioned complaint case.
Learned counsel for the applicant submits that the impugned order dated 18.6.2018, passed by Additional Session Judge/Special Judge (U.P. D.A.A.), Lalitpur is manifestly illegal and is liable to be quashed by this Court.
Having heard the learned counsel for the applicant and the learned A.G.A. for the State and upon perusal of the record, it appears that the concerned court has rejected the complaint filed by the applicant on the ground that the proceedings have been engineered by the office bearers of the society against some other officer bearers.
The court concerned did not find any such ground to take cognizance of the complaint.
This court does not find any good reason to interfere with the order impugned in the present application. Consequently, the present application fails and is dismissed.
