JUDGMENT / ORDER

Court No. - 58
Case :- WRIT - A No. - 25179 of 2018 Petitioner :- Vinod Kumar Pandey Respondent :- State Of U.P. And 2 Others Counsel for Petitioner :- Banshi Dhar Mishra Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioner claims to be the senior most Class-IV employee of the Institution, who is eligible and entitled to be promoted to the post of Assistant Clerk, which is lying vacant. Grievance is that the petitioner's claim is not being examined by the authority concerned.
A perusal of the record would go to show that the District Inspector of Schools, Basti has alredy taken cognizance of the petitioner's claim in that regard and a direction has been issued to the Committee of Management of the Institution to take necessary steps.
In view of the fact that cognizance has been taken by the District Inspector of Schools, Basti, on the petitioner's claim and necessary directions have been issued, this Court finds no good ground to interfere in the matter, at this stage.
It is, however, provided that the District Inspector of Schools, Basti shall conclude the exercise initiated in the matter from October, 2018, after affording an opportunity of hearing to the respondent no. 3 or any other eligible person, who may have raised their claim, in that regard, within a period of three months from the date of presentation of certified copy of this order.
With the aforesaid observations, writ petition stands disposed of.
