Pursuant to the order dated 20.5.2019, learned A.G.A. has placed instructions received on behalf of S.H.O., P.S. Kareli, District Prayagraj before the Court which is taken on record and from which it reflects that, in fact, the corpus whose custody is being claimed by petitioner no.1 has already lodged a first information report against him under Sections 498- A, 323, 504, 506, 406 and 3/4 of D.P. Act on 13.3.2019 vide Case Crime No.132 of 2019.
In view of aforesaid as the relations between the petitioners are strained and litigation is going on, it would not be proper for the Court to pass a writ or direction in the nature of habeas corpus directing the petitioner no.2, wife of petitioner no.1 to appear before this Court.
The present habeas corpus writ petition is bereft of merits and the same is, accordingly, dismissed.
