On the case being taken up today for hearing Shri Sameer Jain, learned counsel for the applicants, learned AGA for the State and Shri Shashank Tiwari, holding brief of Shri Vikash Bhatnagar, learned counsel for opposite party no. 2 are present.
A Supplementary affidavit has been filed today by learned counsel for the applicants and same is taken on record.
It is contended by learned counsel for the applicants that present dispute was in respect of business transaction in which parties have entered into compromise and have amicably settled the dispute. It is further contended that in respect of compromise arrived at, a compromise deed has also been prepared and the same is filed on the record of this case. He further submitted that as per compromise arrived at, entire agreed amount Rs. one crore has been paid by the applicants which the opposite party no. 2 has received and now no dispute remains between the parties.
Learned counsel appearing for opposite party no. 2 admits the aforesaid facts saying opposite party no. 2 has no objection if proceedings of the case are quashed.
Accordingly, application is allowed.
Proceedings of Case No. 679 of 2013 (State vs. Smt. Usha Gupta and others), under section 406, 419, 420, 471, 120B I.P.C., P.S. Bhelupur, District Varanasi, pending in the court of IIIrd Additional Chief Judicial Magistrate, Varanasi are quashed.
