The sole relief claimed in the instant petition is for issuing direction to respondent no.1, before whom SCC Suit No.229 of 2009 is pending at the behest of the petitioners, to decide the same within a specified time frame.
Counsel for the petitioners submitted that the defendant is seeking regular adjournments and is delaying the disposal of the proceedings.
A perusal of the order sheet to some extent supports the submission made in this regard by counsel for the petitioners. The suit is pending since the year 2009.
Having regard to the above facts, the instant petition is disposed of by directing the trial court to make endeavour to decide the suit expeditiously, without granting unnecessary adjournments to the parties.
