Court No. - 38
Case :- WRIT - A No. - 14896 of 2019 Petitioner :- Vinod Kumar Dwivedi Respondent :- State Of U.P. And 3 Others Counsel for Petitioner :- Prakash Chandra Dwivedi,Nripendra Kumar Dwivedi Counsel for Respondent :- C.S.C.
Hon'ble Ashwani Kumar Mishra,J.
Petitioners is claiming notional increment from 1.7.2010 to 30.6.2011 and that his claim has not been considered in that regard.
The petition is opposed by learned Standing by submitting that petitioner claim is highly belated.
Admittedly, all petitioner has retired on 30.6.2011. No claim was raised for grant of such benefit within a reasonable period. The judgment of the Madras High Court is made the basis for petitioners' claim which was delivered on 15.09.2017. This judgment would not constitute any basis for the petitioner to seek revision of salary almost after expiry of sufficient period. A fresh representation is not required to be entertained for reopening of such issues, after long lapse of time. No direction, therefore, is required to be issued, as is prayed for, in this petition.
The writ petition is, accordingly, dismissed.
