JUDGMENT / ORDER

This application has been filed for extension of time to comply with the order dated 6.11.2013 passed by this Court whereby the interim order was modified and the eviction from the shop in dispute had been stayed subject to deposit of the rent at the rate of Rs. 800 per month. It was also that the entire decretal amount be also deposited. The deposits were to be made within a month.
It has been stated in the affidavit in support of the application for extension of time that the order could not be complied with on account of illness of the petitioner.
Learned counsel for the landlord states that since the deposit has not been made within the time stipulated an order for eviction of the petitioner from the accommodation in dispute has been passed. He further states that he is only interested in getting the property vacated and is not interested in the decretal amount as also rent at the enhanced rate.
Since the interim order has been in operation since 2001, it is thought fit that seven days further time be granted to the petitioner to comply with the order dated 6.11.2013. In case the compliance is not made within the stipulated period the writ petition shall stand dismissed without any further reference to the Court.
