Heard learned counsel for the applicant, learned AGA and perused the record.
Learned counsel for the applicant submitted that the First Information Report was lodged against unknown person. However, the name of the applicant along with the co- accused was disclosed in the statement recorded under Section 161 Cr.P.C. However, in the statement of witness Udai Kumar specific role of firing was assigned to co- accused Ranpal who has already been released on bail. The presence of the applicant was also shown at the place of incident. The applicant is in jail since 5.4.2010.
In view of the above, without expressing opinion on merit, let the applicant Vinod alias Kale be enlarged on bail on his furnishing a personal bond with two sureties each in the like amount to the satisfaction of the court concerned in Case Crime No. 83/2010 under Section 302 I.P.C. PS Indirapuram District Ghaziabad.
