In view of the order proposed to be passed, notice need not issue to the private-respondents.
The petitioner is before this Court for a direction to the Civil Judge (Senior Division)/F.T.C., Bijnor to decide the Original Suit No. 454 of 2006 (Anupam Mathur v. Dr. Vinit Mathur) within stipulated period.
Considering the facts and circumstances of the case, without expressing any opinion on the merits of the issue, the present petition stands disposed of finally with a direction to the Civil Judge (Senior Division)/F.T.C., Bijnor to consider and decide the aforesaid suit in accordance with law expeditiously but certainly after giving opportunity to the parties concerned and without granting unnecessary adjournments to either of the parties, if there is no legal impediment.
