JUDGMENT / ORDER

In view of the contention raised with regard to the territorial jurisdiction as well as referring to the affidavit of the son of Respondent No.2 at Annexure-B, the following order is passed:
Rule, returnable on 30.11.2012.
Learned APP Ms.Archana Raval, waives service of notice of Rule for Respondent No.1-State of Gujarat.
Ad-interim relief in terms of Para No.8(c) till then.
