This writ petition has been filed praying for a mandamus to be issued to promote the petitioner on the post of Clerk as according to her there are four posts lying vacant in the Nagar Palika Parishad, Sirsaganj, District Firozabad and the petitioner has requisite qualification and she has been working in the Nagar Palika Parishad concerned since long on a Class IV post.
There is 20% quote prescribed for promotion of Class IV employees to Class III post. She has filed repeated representations before the Executive Officer and Chairman of the Nagar Palika Parishad, Sirsaganj, District Firozabad and her representations have remained un- disposed of.
Heard learned counsel for the petitioner and Shri Saurabh Tiwari, learned counsel appearing on behalf of respondents no. 2 and 3.
This writ petition is disposed of, without entering into the merits of the controversy, with a direction to the respondents no. 2 and 3 to look into the grievance of the petitioner as mentioned in her representations and pass appropriate orders thereon within a period of three weeks from the date a certified copy of this order is produced before him.
It is made clear that in case the Nagar Palika Parishad, Sirsaganj, District Firozabad decides to go ahead with the procedure for making promotions from Class IV to Class III posts, it shall consider all eligible candidates by taking proper sanction from the competent authority and publicize the same on the notice board and by other means, asking all Class IV employees of the Nagar Palika Parishad, Sirsaganj, District Firozabad for applications.
