Heard learned counsel for the applicant, and learned A.G.A. for the State.
This bail application has been moved by the accused-applicant Vineeta who is involved in Case Crime No. 63/2016, under Sections 498A, 302, 201 I.P.C. & 3/4 D.P. Act, Police Station- Qila, District Bareilly.
It is contended by learned counsel for the applicant that applicant is sister-in-law (Nanad) of deceased Richa. Rakesh Kumar Diwakar @ Ramu is husband of deceased. There is no any specific role of demand of dowry or harassment against applicant. Co-accused Dhakan Lal (Father-in-law) and Smt. Savitri Devi (Mother-in-law) have been enlarged on bail by this Court vide orders dated 02.08.2016 & 31.08.2016, passed in Criminal Misc. Bail Application Nos. 23300/2016 & 30012/2016 respectively, copies of which filed at Annexure-7.
Learned A.G.A. has opposed the prayer for bail.
The case of applicant is on better footing to that of co-accused Dhakan Lal and Smt. Savitri Devi.
Without expressing any opinion on the merits of the case and considering the facts and circumstances of the case, I find it a fit case for enlarging the applicant on bail.
Let the applicant Vineeta be released on bail in the aforesaid case crime number on furnishing a personal bond and two reliable sureties of the like amount to the satisfaction of the Magistrate concerned.
