This application under Section 482 Cr.P.C. has been filed with a prayer to to set aside the impugned order dated 14.08.2018 passed by the learned Principal Judge, Family Court, Bulandshahar in Maintenance Case No. 285 of 2017 (Smt. Suneeta Rani Vs. Vineet Kumar) under Section 125 Cr.P.C., District Bulandshahar.
It has been submitted by the learned counsel for the applicant that the opposite party no. 2 filed an application for maintenance under Section 125 Cr.P.C. on 01.05.2017 in which the learned Principal Judge, Family Court, Bulandshahar passed the order dated 14.08.2018 directing the applicant to pay Rs. 6,000/- per month to the opposite party no. 2 as maintenance from the date of filing of the application. The applicant has moved an application under Section 126(2) Cr.P.C. on 27.05.2019 for recalling the order dated 14.08.2018 stating that it was an ex parte order.
In view of the facts and circumstances stated above, the concerned court below is directed to decide the application under Section 126(2) Cr.P.C. moved by the applicant dated 27.05.2019 within one month in accordance with law from the date of production of certified copy of this order.
With the observations made above, this application under Section 482 Cr.P.C., accordingly, disposed of.
