Heard learned counsel for the applicant and learned AGA for the State.
This application has been filed by the applicant with a prayer to quash the order dated 27.02.2019 issuing non- bailable warrant and initiate proceeding under Section 82 Cr.P.C. against the applicant in Complaint Case No.1050 of 2013, under Sections 498A IPC and 3/4 D.P. Act, pending in the court of A.C.J.M./C.J. (S.D.), District Sant Kabir Nagar.
Applicant claims that because of illness, he could not appear before the court below. Now the applicant undertakes that he will participate in the proceeding of the lower court.
Heard learned AGA for the State.
Since applicant has expressed his desire to participate in the proceeding, let a written undertaking be moved before the court below that applicant shall remain present and cooperate in the proceeding of the court below and he shall not occasion any delay in disposal of the trial, then case of the applicant shall be considered sympathetically and he shall be allowed to participate in the proceeding.
With the above direction, the instant application under Section 482 Cr.P.C. is finally disposed of.
