Heard Sri Ravindra Kumar Srivastava, learned counsel for the petitioner and learned Standing Counsel for respondents No.1 to 3. Notice need not be issued to respondents No.4 and 5 at this stage.
This writ petition has been filed with the following prayer:
"issue a writ order or direction in the nature of mandamus commanding/directing the respondent no.2/Up Ziladhikari/Joint Magistrate, Tahsil - Sadar, District- Maharajganj to decide/dispose of Appeal No.T202105470101440 Ashok Kumar Singh and another versus Israr Khan and other under Section 35(2) U.P. Renenue Code 2006, pending before him expeditiously within the period fixed by the Hon'ble Court and to pass appropriate order within the reasonable time as fixed by the Hon'ble High Court."
It is contended that proceedings for mutation was allowed in the year 2019 against which an appeal has been filed by the petitioner on 28.01.2021, which is pending consideration. The sole prayer is for early disposal of the aforesaid appeal.
As no useful purpose would be served in keeping the matter pending, with the consent of the parties, the matter is being disposed of at this stage without calling for counter affidavit or issuing notice to respondents, with a direction upon respondent no. 2 to decide the aforesaid appeal of the petitioner, if there is no legal impediment, after hearing all the concerned parties, strictly in accordance with law by reasoned and speaking order, expeditiously, preferably within a period of six months from the date of production of copy of this order, downloaded from the official website of Allahabad High Court.
Writ petition stands disposed of.
