Court No. - 29
Case :- SPECIAL APPEAL DEFECTIVE No. - 187 of 2019 Appellant :- Vinay Kumar And 4 Others Respondent :- State Of U.P. And 2 Others Counsel for Appellant :- Seemant Singh Counsel for Respondent :- C.S.C.,Manish Goyal
Hon'ble Pankaj Mithal,J. Hon'ble Saumitra Dayal Singh,J.
Heard Sri Seemant Singh, learned counsel for the appellants and Sri Ashish Mishra, learned counsel for respondent nos. 2 and 3.
The minimum eligibility qualification for the post of Junior Assistant, apart from other things, is Course on Computer Concepts (CCC) Certificate from DOEACC Society.
Admittedly, the petitioner-appellants were not possessing the said certificate on the last date of the submission of the application form and in view of the statement of the learned counsel made in this respect, the writ petition was dismissed. Now, the argument is that the petitioner- appellants have obtained the aforesaid certificate from DOEACC Society but admittedly after the last date of the submission of application forms.
In view of the above, we do not find any illegality in cancelling the appointment of the petitioner-appellants and in the order dismissing the writ petition. The appeal lacks merit and is accordingly dismissed.
The appeal is also beyond time by 746 days. Therefore it is dismissed both on the ground of delay and merits.
