Heard learned counsel for the petitioner and learned Standing counsel for the State-respondents.
The petition has been filed seeking the following relief-
"i) to issue a writ, order or direction in the nature of mandamus directing and commanding the respondent no.2 Sub Divisional Magistrate, Tehsil Kasaya, District Kushi Nagar to decide the Case No.197/2013, Computerized Case No.T201605440405175 (Vijay Kumar and others Vs. Ram Nakshtra and others) U/s 24 U.P. Revenue Code, 2006 pending in the Court Sub Divisional Magistrate, Mandal Gorakhpur, Tehsil Kasaya, District Kushi Nagar within stipulated time frame as fixed by this Hon'ble Court."
It is stated that the demarcation case under Section 24 of the U.P. Revenue Code, 2006 filed by the petitioner is pending consideration since 2013.
Under the circumstances, this writ petition is disposed of directing the respondent no.2 Sub Divisional Magistrate, Tehsil Kasaya, District Kushi Nagar to endeavour to decide the case of the petitioner, expeditiously, preferably within a period of three months from the date a certified copy of this order is filed before him.
