By impugned order dated 15.7.2019, the Principal Judge, Family Court, Fatehpur, on an application under section 24 of the Hindu Marriage Act, has proceeded to award litigation expenses to the respondent-wife.
A Full Bench of this Court in the case of Kiran Bala Srivastava vs. Jai Prakash Srivastava, 2006 All.C.J. 1936 has held that against order under Section 24, appeal lies under Section 19 of the Family Courts Act. In such view of the matter, this petition is dismissed with liberty to the petitioner to avail the alternative remedy.
In case, counsel for the petitioner files an application for return of certified copy of the impugned order before the Registry, the same shall be returned after retaining a photostat copy of the same on the record.
