Heard learned counsel for the petitioner. Learned Standing counsel has appeared for the respondents.
The respondents are constructing the Railway over- bridge.
The argument of learned counsel for the petitioner is that for the purposes of construction of aforesaid over-bridge the land near the school of the petitioner has been surveyed for the purposes of constructing the said over- bridge.
On being repeatedly asked learned counsel for the petitioner submits that so far no part of the petitioner's land or the land belonging to the School is being utilized or proposed to be utilized for construction of the over- bridge.
In view of the above, if any construction of the over-bridge is being made on the land other than that of the petitioner, the petitioner is not the person aggrieved to maintain the writ petition.
The petition is misconceived and is dismissed.
