This case is listed peremptorily today. No one has appeared on behalf of the revisionist to press this revision even in the revised call.
This revision is directed against the judgment and order dated 19.8.2008 passed by the Chief Judicial Magistrate, Allahabad in Case No.2621 of 2008, Vinay Kumar Singh Vs. Ganga Prasad, whereby the complaint under Section 138, Negotiable Instruments Act has been dismissed by the trial court on the ground of being time barred.
Shri K.D. Awasthi, learned counsel for the opposite party No.2 is present. He informs that the contesting opposite party No.2 has already died.
In view of the fact that opposite party No.2 has died and no one has appeared to argue this revision, although his legal heirs has been substituted, this revision is dismissed as infructuous.
