Shri Sishir Chandra learned counsel for the opposite party no 3 has placed before this court an order dated 6th July 2019 by which the application of the petitioner Vinay Kumar Singh in respect of the election held on 09.06.2019 has been rejected. In the writ petition the petitioner has prayed for quashing of the election of Manager in the bye election to the committee of management of Janta Madhyamik Vidyalaya, Lagucha, Pargana Kheri Dist Lakhimpur Kheri held on 09.06.2019. The second prayer is for issuance of a writ of mandamus directing the Registrar of the Societies, Firms and Chits, U.P., Lucknow for opening fresh membership of the general body of Janta Madhyamik Vidyalaya, Lagucha, Pargana Kheri Dist Lakhimpur Kheri in future.
As regards the first relief the remedy was before the D.I.S, who if he finds the dispute pertaining to election to the committee of management of the college to be genuine, can forward the same to the regional level committee. As per the order produced by Shri Sishir Chandra the said decision has been taken on 06.07.2019 on the petitioners application which has been rejected but the said decision has not been challenged.
As regards relief number 2 if there is any dispute with regard to membership of the general body then the same would be amendable u/s 4B of the Societies Registration Act 1860 before the Registrar. It is not for the Deputy Registrar to enroll new members of the society.
In view of the above this writ petition is not liable to be entertained by this court. If the petitioner is aggrieved by the order dated 06.07.2019 a copy of which has been provided to him during the course of hearing he may challenge the same subject, of course, to maintainability of such challenge.
With these observations the petition is disposed off. The copy of the order dated 06.07.2019 provided by Sishir Chandra is kept on record.
