Only prayer made in the present petition is to issue a direction to the Court below to decide the Misc. Case No. 23/74/11 under Order 9 Rule 13 CPC moved by some of the defendants.
Perused the order sheet, without expressing any opinion as to the merits of claim of the petitioner, the present petition is being disposed of with the direction to the Court below namely the Civil Judge (Senior Division), Fatehgarh, Farrukhabad to decide the Misc. Case No. 23/74/11 (Awadhesh Chandra Dixit and others vs. Vinay Kumar Shakya and another) under Order 9 Rule 13 CPC, as expeditiously as possible, preferably, within a period of two months from the date of submission of certified copy of this order, after giving due opportunity to all concerned.
