Heard Shri Rakesh Kumar Tripathi, learned counsel for the petitioner, Shri Ajay Kumar Patel holding brief of Shri Adarsh Bhushan, learned counsel for the respondents no.2 & 3 and the learned counsel for the respondent no.1.
According to the petitioner he appeared in the selection for the post of Technician Grade-II (Trainee) (Post Code-3) in pursuance of the Advertisement No.6 of 2015 in which he appeared as an OBC candidate. According to him cut off merit of OBC candidate is 120.33 whereas he has secured 130 marks as per the averment in paragraph 12 of the writ petition.
No useful purpose would be served by keeping this writ petition pending.
The writ petition is, therefore, disposed of with the consent of the learned counsel for the parties with the direction that if the petitioner prefers a fresh representation before the respondent no.2, Secretary, Electricity Service Corporation, Lucknow raising all his grievances as raised in the present writ petition within a period of 15 days from today alongwith the certified copy of this order, the respondent no.2 shall consider and decide the same in accordance with law within a further period of one month.
It is made clear that the Court has not adjudicated the claim of the petitioner on merits.
