Heard learned counsel for the applicant and learned A.G.A. for the State.
By means of the present application under Section 482 Cr.P.C., the applicant has sought for a suitable direction to Chief Metropolitan Magistrate, Kanpur Nagar to consider and decide Application No. 3118 of 2017 (Vinay Jha Vs. Pawan Kumar and others), under Section 156(3) Cr.P.C., Police Station Fajalganj, District Kanpur Nagar within time stipulated by this Court.
It was submitted by learned counsel for the applicant that applicant has filed an application under Section 156(3) Cr.P.C. on 20.06.2017 before the court below but the same has not been decided so far. Learned counsel further submits that a direction may be issued to the concerned Court to decide the same within specific time.
No useful purpose would be served in keeping the application pending, which is finally disposed of with a direction to Chief Metropolitan Magistrate, Kanpur Nagar to consider and decide Application No. 3118 of 2017 (Vinay Jha Vs. Pawan Kumar and others), under Section 156(3) Cr.P.C., Police Station Fajalganj, District Kanpur Nagar expeditiously, in accordance with law, preferably within a period of three months from the date of production of certified copy of this order, if there is no other legal impediment.
