Alleging that the petitioner is in love with Anusree.K., the daughter of the 5th respondent, and that in order to prevent her from continuing the relationship, she is being illegally detained by her father, the petitioner has filed this Writ Petition.
2. In order to satisfy ourselves about the genuineness of the case of the petitioner, we, by order dated 18.6.2014, directed the learned Government Pleader to obtain instructions in the matter. Accordingly, an enquiry was conducted by the 4th respondent, who also got a statement of the detenue recorded by a woman civil police officer on 26.6.2014. In her statement, The alleged detenue, who is a 4th semester Degree student, confirmed that she had acquaintance with the petitioner and that marriage proposals made by the petitioner were not approved by her family. It is stated that when the relationship was not approved by the family, the petitioner himself had informed her that he will not create any trouble to her. It is W.P.(Crl) No.257/2014 2 stated that her marriage with another person is almost fixed and that it is to create further trouble, this writ petition is filed. She has also confirmed that she is not being detained by either her parents or anybody else. These facts are confirmed by the 4th respondent in his report also.
3. Disclosures made by the detenue and the facts gathered by the 4th respondent show that the case of the petitioner that alleged fiancee is being illegally detained by her father is factually incorrect. We are, therefore, not satisfied that this is a fit case for entertaining the Writ Petition with the prayer for the issue of a writ of habeas corpus.
Writ Petition fails and it is accordingly dismissed.
