JUDGMENT / ORDER

Exactly same point is involved in this writ petition as was involved in writ petition no. 42940 of 1997 which has been allowed today. The only difference is that number of Misc. case which was decided by the labour court through the order challenged through this writ petition was 16 of 1996.
Accordingly, this writ petition is also allowed on the same ground on which the other writ petition has been allowed. The impugned order dated 17.11.1997 passed by Presiding Officer Labour Court U.P. Agra under Section 33-C(2) of Industrial Disputes Act is set aside.
