JUDGMENT / ORDER

(Per : HONOURABLE MR.JUSTICE D.H.WAGHELA)
1. The petitioner has sought temporary bail for 30 days for treatment of his dental ailment by a private doctor.
2. According to certificate dated 28.12.2011 of Medical Officer, Central Jail Dispensary, Ahmedabad, he is having complaint of pain with pus discharge from upper first teeth of right side. He has been examined by dental surgeon from Civil Hospital during camps held on 25.08.2010 and 22.12.2010 and treated accordingly. On 23.11.2011, he was examined by dental surgeon from Civil Hospital during dental camp at jail dispensary and was advised extraction of the tooth but he refused to take further treatment. It, therefore, appears that inspite of the treatment being available, the petitioner is insisting upon treatment from outside. According to his jail record, he has never been released on parole, furlough or temporary bail and hence, has no record of returning to jail in time.
3. Under the circumstances, the application is rejected, as no sufficient ground is made out.
