JUDGMENT / ORDER

The petitioner is arrayed as one of the accused in Crime No.61 of 2013 on the file of the respondent police and a case has been registered against him for the offences punishable under Sections 323, 324, 506(ii) of IPC and Section 3(1)(x) of the SC/ST Act and it has been numbered as SSC No.104 of 2013 and pending on the file of the I Additional PCR Court, Tanjavur. It is stated by the petitioner that as against him, a non-bailable warrant has been issued by order dated 09.11.2013 for his non-appearance before the Court on that date, and now the case is adjourned to 31.01.2017. Hence this petition has been filed seeking a direction to the Trial Court to accept his surrender and to consider the petition to recall his warrant on the very same day.
2. Mr.C.Emalias, learned Additional Public Prosecutor, takes notice for the respondent.
3. Heard both sides.
4. Considering the facts and circumstances of the case, the learned I Additional PCR Judge, Tanjavur, is directed to accept the surrender of the petitioner and consider his petition to recall the warrant on the very same day purely on the basis of merits and to pass suitable orders, in the event of the petitioner surrendering before the said court within 15 days from today and filing of such petition.
5. This petition is ordered accordingly.
