Counsel for the applicant states that he has been served a counter affidavit wherein it has been averred that the case sought to be transferred by means of this transfer application has, on a withdrawal application filed by the opposite party, been withdrawn.
Under the circumstances, the transfer application has necessarily been rendered infructuous, and is liable to be dismissed as such.
The transfer application is accordingly dismissed as infructuous.
It is however left open for counsel for the applicant to seek recall of this order in case, the averments made in the counter affidavit served upon him are found to be factually incorrect.
