Heard Sri Brajesh Kesarwani, learned counsel for the petitioner, Sri S.D. Kautilya, learned counsel appearing for respondent no.3 and Sri B.K. Ojha, learned counsel for the respondent no.4.
The petitioner is complaining that the private respondents are digging the public road and are raising illegal constructions over it. Accordingly he wants that a direction be issued to decide his application dated 20.07.2019 which he has addressed to the S.D.M, Prayagraj. The application is also to the same effect as mentioned above.
The petitioner has not approached the appropriate authority for the settlement of his grievance. In case any such thing is happening, the remedy of the petitioner is to proceed under Section 133 Cr.P.C. or to take recourse to other remedies as may available to him in law.
Accordingly, the writ petition is dismissed.
